4. Uninsured and Unidentified Coverage

Your standard insurance policy is also responsible for payment of money for any damages or losses you may suffer as a result of an accident with a vehicle whose owner or driver is uninsured. Similarly, you are covered for personal injuries suffered in a hit-and-run , where the owner or driver of the automobile that was at fault for the accident cannot be identified. Similarly, the family members of the insured who suffers personal injury or death, as a result of accident with an uninsured or unidentified vehicle, may also entitled to receive money from the insured person’s insurance policy, for loss of care, guidance, and companionship, among others.

Every contract of insurance provides for the coverage discussed below and every insured is entitled to receive under each of the grounds listed:

  • If insured suffers personal injury or death, as a result of accident with an unidentified or uninsured vehicle, the insured, his or her spouse, and his or her dependent relatives are entitled to receive damages for personal injury or death, from their insurer. Similarly, the insured and his or her spouse and his or her dependent relatives (so long as the dependent relatives do not have their own insurance policy and so long as the accident is not with the uninsured vehicle of the dependent relative while the relative is an occupant of the uninsured vehicle) are covered in the event of personal injury or death, while the said individuals or any one of them are occupants of an uninsured vehicle or a pedestrian.
  • The law also requires every contract of motor vehicle insurance policy to provide similar coverage for damage to insured’s automobile and/or its content. an owner or lessee of a vehicle is entitled to coverage for damage to his or her automobile and its contents, as a result of an accident with an uninsured automobile.
